Sale of a converted barn

In September 2016 we were acting on behalf of farmer clients who sold a barn.  We had to provide rights of access for maintenance and repair of adjoining shared boundaries, grant rights of drainage from the barn into the farmer’s adjoining field, retain a right for the benefit of the farmer to drain into the septic tank situate in the garden ground of the barn but most challenging of all were the water rights.  The barn was to take a supply from a natural spring across several fields and within four different titles creating shared rights and responsibilities relating to the maintenance of the water supply pipe.  Finally there were restrictions to be imposed preventing future development so that uninterrupted views across the valley were not going to be impaired by future development.  This is all very interesting but does take a great deal of time and effort to ensure the rights and obligations are correctly created bearing in mind these provisions are likely to last for decades.
